Auction Terms and Conditions

 

1. General

1.1 By registering for and participating in our auctions, bidders agree to be bound by these terms and conditions.

2. Registration and Bidding

2.1 All bidders must register with PRS before participating in any auction. Register here

2.2 Bidders must provide accurate and complete information during registration, including full name and address. Online bidders are required to register with a valid credit card. PRS reserves the right to verify this information.

2.3 If no payment or arrangements have been made within 48 hours of the auction, we reserve the right to charge your credit card for your purchases.

2.4 Bids are binding contracts. By placing a bid, you agree to purchase the item if you are the highest bidder at the auction’s close.

2.5 The Auction reserves the right to refuse any applicant for a bidding card, the privilege of bidding at the Auction Sale, and to revoke such privilege at any time.

3. Item Descriptions and Conditions

3.1 Items are tested to varying degrees: Untested, Tested for Power, and Fully Tested.

3.2 If no condition is mentioned in the description, the item is considered untested.

3.3 While we strive to test items thoroughly, there may be instances where certain issues are missed.

3.4 All items are sold “as is, where is” with no guarantees or warranties.

3.5 PRS Product Repurposing Solutions Inc. makes no guarantees regarding the condition, functionality, or accuracy of descriptions for any items sold.

4. Pickup

4.1 Winning bidders are responsible for arranging pickup of items.

4.2 Pickup appointments must be made prior to picking up. You will receive an email to book your pickup. If you do not have an appointment, you will not be served until you have made one.

4.3 All purchases must be removed no later than 3 business days after the auction unless stated otherwise by the auctioneer. Removal shall be at the expense, risk, and liability of the purchaser. Purchases can be removed only on presentation of a paid bill.

4.4 Auctioneer shall not be responsible for goods not removed within the time allowed but shall have the option to remove and store at the expense and risk of the purchaser any article purchased but not paid for and removed within the time aforesaid.

4.5 All costs associated with pickup are the responsibility of the winning bidder.

5. Shipping

5.1 PRS offers shipping to Canada and the US.

5.2 PRS will professionally package your item. Once we have received payment for your invoice with your shipping cost, we will purchase the label through our own accounts. All costs associated with shipping are the responsibility of the winning bidder.

5.3 For Canadian shipments of non-freight items, shipping can take 2-7 business days with a maximum of 3 days for handling.

5.4 For US shipments of non-freight items, shipping can take 3-7 business days with a maximum of 3 days for handling.

5.5 For US shipments containing lithium-ion batteries, shipments can take longer.

5.6 For US buyers, shipments valued at $800 USD or less will not incur any customs, duties, or taxes. We use a service called Chit Chats, which takes your shipment over the border and ships it via USPS. Chit Chats typically gets the package over the border within one business day of receiving it from us, allowing for a fast and smooth international transaction.

5.7 For US orders over $800 USD, we have to ship from Canada internationally, and these orders will incur customs and duties fees.

5.8 Shipping insurance will automatically be added to orders of $300 or more.

5.9 For orders that are being shipped, shipping and handling charges will be added to your invoice. Please allow up to 3 days to receive your invoice with shipping charges. The buyer agrees to pay these shipping charges when they bid.

5.10 A 25% fee will be applied to the shipping costs to cover time and packing materials. For example, if shipping costs $20, an additional $5 will be charged (total shipping cost will be $25).

6. Payment

6.1 Payment for winning bids that are being shipped must be made within 3 days of receiving the invoice. In some instances, the invoice with the shipping quote may take 1-5 business days to be sent out.

6.2 Orders of $999 or more cannot be paid by credit card and must be paid by cash, e-transfer, or wire transfer, whether for shipping or in-person pickup.

6.3 Payments can be made by credit card (under $999) or e-transfer prior to pickup. E-transfer payments need to be made prior to picking up. We will call you to confirm and set a pickup time.

6.4 Items paid at pickup can be paid by debit card, cash, or credit card (for amounts under $999).

6.5 All purchases are subject to your provincial taxes:

  • Alberta: 5% GST
  • British Columbia: 5% GST + 7% PST
  • Manitoba: 5% GST + 7% PST
  • New Brunswick: 15% HST
  • Newfoundland and Labrador: 15% HST
  • Northwest Territories: 5% GST
  • Nova Scotia: 15% HST
  • Nunavut: 5% GST
  • Ontario: 13% HST
  • Prince Edward Island: 15% HST
  • Quebec: 5% GST + 9.975% QST
  • Saskatchewan: 5% GST + 6% PST
  • Yukon: 5% GST

6.6 Fees are non-negotiable.

7. Returns and Refunds

7.1 All sales are final. PRS does not accept returns or provide refunds.

7.2 In the event of a dispute, the decision of PRS shall be final.

8. Limitation of Liability

8.1 PRS Product Repurposing Solutions Inc. is not liable for any damages or losses resulting from participation in our auctions, including but not limited to direct, indirect, incidental, or consequential damages.

8.2 Bidders agree to hold PRS Product Repurposing Solutions Inc. harmless from any claims or liabilities arising from the purchase or use of auction items.

9. Governing Law

9.1 These terms and conditions shall be governed by and construed in accordance with the laws of British Columbia.

9.2 Any disputes arising from or related to these terms and conditions shall be resolved exclusively in the courts of British Columbia.

11. Identification

12. Removal

13. Item Condition

13.1 All lots are sold “as is, where is” and at the sole risk of the buyer. Neither the Auctioneer nor the Principal makes any representation or warranty as to the condition or operability of the lot nor in respect of any other matter whatsoever.

13.2 The Auctioneer shall not be responsible for the correct description, genuineness, authenticity of, or defect in any lot. All sales are final. No sale will be set aside nor allowance made on account of any incorrectness, error in cataloguing, or imperfection not noted. No deduction will be allowed on damaged or non-operable goods.

14. Claims

14.1 No claims will be allowed after removal of goods from premises.

15. Responsibility for Non-Delivery

15.1 Auctioneer shall not, in any event, be liable for non-delivery or for any other matter or thing, to any purchaser or any lot, other than for the return to the purchaser of the deposit or sum paid on said lot, should the purchaser be entitled thereto.

16. Compliance with Terms of Sale

16.1 In default of payment of bills in full within the time specified, the auctioneer, in addition to all other remedies allowed by law, may retain all moneys received as deposit or otherwise, as liquidated damages.

16.2 Lots not paid for and removed within the time allowed herein may be resold at public or private sale without further notice, and any deficiency, together with all expenses and charges of re-sale, will be charged to the defaulting purchaser.

17. Addition to or Withdrawal from Sale

17.1 The auctioneer reserves the right to withdraw from this sale any of the items listed or to sell at this sale items not listed, and also reserves the right to group one or more lots into one or more selling lots or to subdivide into two or more selling lots.

17.2 Whenever in the best interest of the seller, the auctioneer reserves the right to sell all property listed in bulk.

18. Dispute Between Bidders

18.1 If any dispute arises between two or more bidders, the auctioneer may decide, or put the lot up for sale again at once, and resell to the highest bidder. The auctioneer’s decision shall be the final and absolute one.

19. Reserve

19.1 The auctioneer reserves the right to reject any and all bids. On lots upon which there is a reserve, the auctioneer shall have the right to bid on behalf of the seller.

20. Agency

20.1 The auctioneer is acting as agent only and is not principal for the acts of its principals.

21. Additional Terms and Conditions

21.1 The auctioneer may add other terms and conditions of sale. Such additional terms and conditions will be announced prior to the auction.
